HB 584 LC 21 3197 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 27-1-3 of the Official Code of Georgia 1- 2 Annotated, relating to ownership and custody of wildlife and 1- 3 the privilege of hunting, trapping, or fishing in this 1- 4 state, so as to provide that three incidents of violation of 1- 5 certain provisions of Title 27 of the Official Code of 1- 6 Georgia Annotated, relating to game and fish, will result in 1- 7 suspension of the violator's hunting, trapping, and fishing 1- 8 privileges; to define a certain term; to provide a penalty; 1- 9 to repeal conflicting laws; and for other purposes. 1-10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-11 Code Section 27-1-3 of the Official Code of Georgia 1-12 Annotated, relating to ownership and custody of wildlife and 1-13 the privilege of hunting, trapping, or fishing in this 1-14 state, is amended by inserting at the end thereof a new 1-15 subsection to read as follows: 1-16 "(h)(1) As used in this Code section, the term 'incident 1-17 of violation' means any act which results in one or more 1-18 specific violations of any of the following provisions 1-19 of this title for which a person is adjudicated guilty, 1-20 pleads guilty or nolo contendere, or forfeits an 1-21 appearance bond: 1-22 (A) Subsection (c) of this Code section; 1-23 (B) Code Section 27-1-28; 1-24 (C) Code Section 27-1-29; 1-25 (D) Code Section 27-1-31; 1-26 (E) Subsection (a) of Code Section 27-1-33; 1-27 (F) Subsection (c) of Code Section 27-2-1; 1-28 (G) Subsections (a), (b), or (c) of Code Section 1-29 27-2-6; 1-30 (H) Subsection (c) of Code Section 27-2-8; -1- (Index) LC 21 3197 2- 1 (I) Code Section 27-3-1; 2- 2 (J) Code Section 27-3-2; 2- 3 (K) Code Section 27-3-7; 2- 4 (L) Code Section 27-3-10; 2- 5 (M) Subsection (a) of Code Section 27-3-17; 2- 6 (N) Code Section 27-3-22; 2- 7 (O) Paragraph (1) of subsection (a) of Code Section 2- 8 27-3-24; 2- 9 (P) Code Section 27-3-48; 2-10 (Q) Code Section 27-3-62; 2-11 (R) Paragraph (2) of subsection (a) of Code Section 2-12 27-3-63; 2-13 (S) Code Section 27-4-2; 2-14 (T) Code Section 27-4-53; 2-15 (U) Code Section 27-4-70; 2-16 (V) Subsection (b) of Code Section 27-4-71; 2-17 (W) Code Section 27-4-74; 2-18 (X) Subsection (b) of Code Section 27-4-92; and 2-19 (Y) Subsection (a) of Code Section 27-4-170. 2-20 (2) Three incidents of violation within a seven-year 2-21 period shall result by operation of law in the 2-22 suspension of the violator's privileges to hunt, trap, 2-23 or fish in this state for a period of five years from 2-24 the date of the third incident of violation. Any person 2-25 who hunts, traps, or fishes during such period of 2-26 suspension shall be guilty of a misdemeanor of a high 2-27 and aggravated nature and upon conviction thereof shall 2-28 be punished by a fine of not less than $1,500.00 nor 2-29 more than $5,000.00 or imprisonment for not more than 12 2-30 months, or both fine and imprisonment; provided, 2-31 however, that the punishment provided for in this Code 2-32 section shall be in addition to any other penalty 2-33 provided by law for any offense stated in paragraph (1) 2-34 of this subsection." -2- (Index) LC 21 3197 SECTION 2. 3- 1 All laws and parts of laws in conflict with this Act are 3- 2 repealed. -3- (Index)
