HB 537 LC 18 6642 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 48-8-85 of the Official Code of 1- 2 Georgia Annotated, relating to referendum elections to 1- 3 decide the imposition of the joint county and municipal 1- 4 sales and use tax, so as to change the period with respect 1- 5 to resubmitting the question of imposition to the voters; to 1- 6 provide for an effective date; to repeal conflicting laws; 1- 7 and for other purposes. 1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 9 To amend Code Section 48-8-85 of the Official Code of 1-10 Georgia Annotated, relating to referendum elections to 1-11 decide the imposition of the joint county and municipal 1-12 sales and use tax, is amended by striking subsection (b) and 1-13 inserting in its place a new subsection (b) to read as 1-14 follows: 1-15 "(b) All persons desiring to vote in favor of levying the 1-16 tax shall vote 'Yes,' and those persons opposed to levying 1-17 the tax shall vote 'No.' If more than one-half of the 1-18 votes cast are in favor of levying the tax, then the tax 1-19 shall be levied in accordance with this article; 1-20 otherwise, the tax may not be levied, and the question of 1-21 the imposition of the tax may not again be submitted to 1-22 the voters of the special district until after 24 12 1-23 months immediately following the month in which the 1-24 election was held. It shall be the duty of the election 1-25 superintendent to hold and conduct such elections under 1-26 the same rules and regulations as govern special 1-27 elections. It shall be his the election superintendent's 1-28 further duty to canvass the returns, declare the result of 1-29 the election, and certify the result to the Secretary of 1-30 State and to the commissioner. The expense of the 1-31 election shall be borne by the county whose geographical 1-32 boundary is conterminous with that of the special district 1-33 holding the election." -1- (Index) LC 18 6642 SECTION 2. 2- 1 This Act shall become effective upon its approval by the 2- 2 Governor or upon its becoming law without such approval. SECTION 3. 2- 3 All laws and parts of laws in conflict with this Act are 2- 4 repealed. -2- (Index)
