HB 387 LC 22 1434 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Chapter 19 of Title 45 of the Official Code of 1- 2 Georgia Annotated, relating to labor practices for state 1- 3 employees, so as to prohibit waiver of certain overtime 1- 4 compensation as a condition of state employment; to prohibit 1- 5 required waiver of certain overtime compensation in advance 1- 6 of working overtime hours; to provide for definitions; to 1- 7 provide for related matters; to repeal conflicting laws; and 1- 8 for other purposes. 1- 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-10 Chapter 19 of Title 45 of the Official Code of Georgia 1-11 Annotated, relating to labor practices for state employees, 1-12 is amended by inserting a new article to be designated dd d� y0x@dp y0x@dVy0x@d<y0x@d�x0x@dix0x@dOx "ARTICLE 3 1-14 45-19-60. (Index) 1-15 As used in this article, the term "overtime hours" means 1-16 hours worked in excess of 40 hours weekly. 1-17 45-19-61. (Index) 1-18 No applicant for state employment shall be required as a 1-19 condition of employment to waive compensation for overtime 1-20 hours if such compensation or a choice between such 1-21 compensation and compensatory vacation hours is required 1-22 by federal law, state law, the rules and regulations of 1-23 the State Personnel Board, or the policy of the state 1-24 employer. 1-25 45-19-62.
