HB 288 HB 288/AP H. B. No. 288 (AS PASSED HOUSE AND SENATE) By: Representatives Snow of the 2nd, Bailey of the 93rd, Perry of the 11th and Carter of the 166th A BILL TO BE ENTITLED AN ACT 1- 1 To amend Part 1 of Article 3 of Chapter 5 of Title 50 of the 1- 2 Official Code of Georgia Annotated, relating to the general 1- 3 authority, duties, and procedure relative to state 1- 4 purchasing, so as to provide for purchases during a declared 1- 5 state of emergency; to repeal conflicting laws; and for 1- 6 other purposes. 1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 8 Part 1 of Article 3 of Chapter 5 of Title 50 of the Official 1- 9 Code of Georgia Annotated, relating to the general 1-10 authority, duties, and procedure relative to state 1-11 purchasing, is amended by striking in its entirety Code 1-12 Section 50-5-71, relating to authorization for emergency 1-13 purchases, and inserting in lieu thereof the following: 1-14 "50-5-71. (Index) 1-15 In case of any emergency arising from any unforeseen 1-16 causes, including delay by contractors, delay in 1-17 transportation, breakdown in machinery, or unanticipated 1-18 volume of work, or upon the declaration of a state of 1-19 emergency by the Governor, the Department of 1-20 Administrative Services or any other department, 1-21 institution, or agency of state government to which 1-22 emergency purchasing powers have been granted by the 1-23 Department of Administrative Services shall have power to 1-24 purchase in the open market any necessary supplies, 1-25 materials, or equipment for immediate delivery to any 1-26 department, institution, or agency of the state 1-27 government. A report on the circumstances of the emergency 1-28 and the transactions thereunder shall be duly recorded in 1-29 a book or file to be kept by the Department of 1-30 Administrative Services." H. B.
