HB 1801 LC 9 8734 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Title 21 of the Official Code of Georgia Annotated, 1- 2 relating to elections, so as to change the penalties for 1- 3 certain felonies involving fraudulent practices in 1- 4 connection with voting and the conduct of primaries and 1- 5 elections; to repeal conflicting laws; and for other 1- 6 purposes. 1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 8 Title 21 of the Official Code of Georgia Annotated, relating 1- 9 to elections, is amended by striking Code Section 21-2-599, 1-10 relating to punishment for felonies under Chapter 2 of Title 1-11 21, and inserting in lieu thereof a new Code Section 1-12 21-2-599 to read as follows: 1-13 "21-2-599. (Index) 1-14 (a) Except as provided in subsection (b) of this Code 1-15 section, any Any person convicted of a felony under this 1-16 chapter shall be punished by a fine not to exceed 1-17 $2,000.00 or imprisonment of not less than one year nor 1-18 more than three years, or both, in the discretion of the 1-19 trial court, or may be punished as for a misdemeanor in 1-20 the discretion of the trial court. 1-21 (b) Any person convicted of a felony under any of the 1-22 following Code sections or portions thereof shall be 1-23 punished by a fine not to exceed $10,000.00 or 1-24 imprisonment of not less than one year nor more than five 1-25 years, or both, in the discretion of the trial court: 1-26 (1) Subsection (a) of Code Section 21-2-562; 1-27 (2) Paragraph (5), (6), or (7) of Code Section 21-2-566; 1-28 (3) Code Section 21-2-571; 1-29 (4) Code Section 21-2-572; or 1-30 (5) Code Section 21-2-590." -1- (Index) LC 9 8734 SECTION 2. 2- 1 Said title is further amended by striking Code Section 2- 2 21-3-479, relating to punishment for felonies under Chapter 2- 3 3 of Title 21, and inserting in lieu thereof a new Code 2- 4 Section 21-3-479 to read as follows: 2- 5 "21-3-479. (Index) 2- 6 (a) Except as provided in subsection (b) of this Code 2- 7 section, any Any person convicted of a felony under this 2- 8 chapter shall be punished by a fine not to exceed 2- 9 $2,000.00 or imprisonment of not less than one year nor 2-10 more than three years, or both, in the discretion of the 2-11 trial court, or may be punished as for a misdemeanor, in 2-12 the discretion of the trial court. 2-13 (b) Any person convicted of a felony under any of the 2-14 following Code sections or portions thereof shall be 2-15 punished by a fine not to exceed $10,000.00 or 2-16 imprisonment of not less than one year nor more than five 2-17 years, or both, in the discretion of the trial court: 2-18 (1) Subsection (a) of Code Section 21-3-443; 2-19 (2) Paragraph (5), (6), or (7) of Code Section 21-3-446; 2-20 (3) Code Section 21-3-451; 2-21 (4) Code Section 21-3-452; or 2-22 (5) Code Section 21-3-469." SECTION 3. 2-23 All laws and parts of laws in conflict with this Act are 2-24 repealed. -2- (Index)
