HB 1070 LC 21 3421 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 47-2-298 of the Official Code of 1- 2 Georgia Annotated, relating to membership by certain former 1- 3 county employees in the Employees' Retirement System of 1- 4 Georgia, so as to change the time in which such creditable 1- 5 service may be obtained; to provide for an effective date 1- 6 and automatic repeal; to repeal conflicting laws; and for 1- 7 other purposes. 1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 9 Code Section 47-2-298 of the Official Code of Georgia 1-10 Annotated, relating to membership by certain former county 1-11 employees in the Employees' Retirement System of Georgia, is 1-12 amended by striking in its entirety subsection (c) and 1-13 inserting in lieu thereof the following: 1-14 "(c) Employees or former employees of a county department 1-15 of family and children services who are subject to the 1-16 provisions of this Code section shall exercise the option 1-17 provided by this Code section by notification in writing 1-18 to the board of trustees of this retirement system, the 1-19 board of trustees or other managing body of the local 1-20 retirement system, and to the county governing authority. 1-21 Such notification must be made by not later than September 1-22 30, 1994 December 31, 1996. For employees or former 1-23 employees of a county department of family and children 1-24 services who become members of this retirement system 1-25 after July 1, 1994 1996, such election and notification 1-26 must be made within 90 days six months of becoming a 1-27 member of this retirement system. Any such employee 1-28 failing to exercise the option granted by this Code 1-29 section within such time limitation shall not at any time 1-30 thereafter be eligible to become a member of this 1-31 retirement system as an employee of a county department of 1-32 family and children services. Any such employee shall 1-33 make payment to the board of trustees of this retirement 1-34 system of a sum equal to their employee contributions -1- (Index) LC 21 3421 2- 1 which had been paid to the local retirement system during N  the years of service for which credit is being claimed and 2- 3 thereafter shall not be entitled to receive any benefit 2- 4 from the local retirement system." SECTION 2. 2- 5 This Act shall become effective on July 1, 1996, only if it 2- 6 is determined to have been concurrently funded as provided 2- 7 in Chapter 20 of Title 47 of the Official Code of Georgia 2- 8 Annotated, the "Public Retirement Systems Standards Law"; 2- 9 otherwise, this Act shall not become effective and shall be 2-10 automatically repealed in its entirety on July 1, 1996, as 2-11 required by subsection (a) of Code Section 47-20-50. SECTION 3. 2-12 All laws and parts of laws in conflict with this Act are 2-13 repealed. -2- (Index)
