HB 1047 LC 21 3532S A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 47-17-80 of the Official Code of 1- 2 Georgia Annotated, relating to retirement benefit options 1- 3 under the Peace Officers' Annuity and Benefit Fund, so as to 1- 4 provide that the benefits of retired members who are 1- 5 employed as a peace officer during a certain period of time 1- 6 shall not be affected; to provide conditions for an 1- 7 effective date and automatic repeal; to repeal conflicting 1- 8 laws; and for other purposes. 1- 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-10 Code Section 47-17-80 of the Official Code of Georgia 1-11 Annotated, relating to retirement benefit options under the 1-12 Peace Officers' Annuity and Benefit Fund, is amended by 1-13 striking in its entirety subsection (g) and inserting in 1-14 lieu thereof the following: 1-15 "(g)(1) Except as provided in paragraph (2) of this 1-16 subsection, any Any member who again becomes employed as 1-17 a peace officer after having been placed on retirement 1-18 under this Code section shall immediately notify the 1-19 secretary-treasurer of such reemployment. Retirement 1-20 benefits being paid to such member shall be terminated 1-21 as of the date of such reemployment and shall remain 1-22 terminated for the duration of such reemployment. 1-23 During such period of reemployment, said member shall 1-24 pay regular monthly dues into this fund. Upon meeting 1-25 the requirements provided by law, such member shall be 1-26 entitled to all benefits provided for in Code Sections 1-27 47-17-81 and 47-17-82; but such member shall not be 1-28 entitled to any increase in retirement benefits by 1-29 virtue of service during the period of reemployment 1-30 unless such reemployment is for a term of three years or 1-31 more, in which instance such member may again apply for 1-32 retirement as if he or she had not previously been 1-33 retired; and he or she shall be entitled to such -1- (Index) LC 21 3532S 2- 1 benefits as may be provided by law at that time, if he 2- 2 or she so chooses. 2- 3 (2) The provisions of paragraph (1) of this subsection 2- 4 shall not apply to a retired member employed in any 2- 5 capacity during the period beginning July 1, 1996, and 2- 6 ending June 30, 1997." SECTION 2. 2- 7 This Act shall become effective on July 1, 1996, only if it 2- 8 is determined to have been concurrently funded as provided 2- 9 in Chapter 20 of Title 47 of the Official Code of Georgia 2-10 Annotated, the "Public Retirement Systems Standards Law"; 2-11 otherwise, this Act shall not become effective and shall be 2-12 automatically repealed in its entirety on July 1, 1996, as 2-13 required by subsection (a) of Code Section 47-20-50. SECTION 3. 2-14 All laws and parts of laws in conflict with this Act are 2-15 repealed. -2- (Index)
